Description:
The eSante Agency National Agency for Shared Health Information G.I.E. is commissioned by the Caisse Nationale de Sante (CNS) and the State of the Grand Duchy of Luxembourg with the aim of setting up an incentive system for the digitization of the health system in Luxembourgourg to promote the deployment of Accelerated Reimbursement (AR) and Immediate Direct Payment (PID). Funding under this scheme is allocated within the framework of open and non-selective referral and funding systems, the management of which is entrusted to the Agence eSante. Based on the Maria Tirkkonen judgment of the Court of Justice of the European Union of March 1, 2018 (case C-9/17), these open and non-selective referencing and financing systems do not constitute public procurement. In this respect, they fall neither under Directive 2014/24/EU nor under Directiveive 2014/25/UE.
